Are you required to update your ESDM Report?

​This regulatory requirement is not new. This information has been posted as a friendly reminder to review your facility's ESDM Report and to update as necessary.


If your facility operates under a North American Industrial Classification System (NAICS) code that is classified as a Schedule 5 facility in Ontario Regulation (O.Reg.) 419/05, then your facility’s ESDM Report may need to be updated.

What part of the ESDM Report would be updated?
As a result, the Emission Summary Table would be updated and air dispersion modelling may be required. The description of sources and new emissions estimation would also be updated to reflect current operations. If nothing has changed and the existing ESDM report reflects current operations, a letter can be appended to the previous year’s report indicating that it is up-to-date.

When is the ESDM Report update required?
The ESDM Report must be accurate as of December 31st of each operating year. The update must be completed no later than March 31st of the following year (i.e. An ESDM report accurate as of December 31, 2016, must be updated by March 31, 2017.)

Are you keeping up with your facility’s modification log?
Facilities operating with an Environmental Compliance Approval (ECA) with limited operational flexibility are required to maintain a modification log. Changes to operations, equipment and/or building envelope that may impact air emissions must be recorded on the modification log for the Annual Written Summary. These changes may trigger a requirement to update the ESDM Report.
 
If operations change such that sources of air emissions are no longer in operation, then the changes must be recorded on the modification log and the ESDM Report must be updated to accurately reflect sources in operation during the previous year.
 
The modification log must be up to date as of December 31 of the reporting year and reported in the Annual Written Summary (AWS). Refer to your facility’s ECA for the reporting deadline.

How long must the ESDM Report be retained for?
Be prepared and ensure that a copy of the most up-to-date ESDM Report is available at your facility, especially to a provincial officer upon request.
 
Retain all versions of the ESDM Report for at least 5 years.

Remember to keep an updated copy of the ESDM Report on file.
